How Does The Process Work?

Manorial Counsel Ltd's website is quite clear. Their "Lordship Title Law" page says, "Our barrister identified legal authorities to create an exclusive legal right to a Lordship title, they do not create a legal right to the lordship, that is left dormant..."

Create? Dormant? What are they selling then?

The first step is some research. Manorial Counsel's conveyance docs refer to this as "reasonable and prudent enquiry." Elsewhere, this is explained as checking the National Archives, Domesday, HM Land Registry, The Gazette, and various public records & publications. 

If the lordship title appears not to have been traded in the last 30 years, the title is deemed to have no provable owner and, thereby, "Dormant." This allows for, as the "Deed of Creation" reads, "Manorial Counsel HEREBY CREATES the lordship title of X." See above for that shocking statement.

Then, on the very next page, the document of "Assignment" assigns the Assignee (Buyer) "the new legal right to use the Lordship Title of X... subject to the conditions and terms set out." The Assignor's research is described as that which can be "reasonably ascertained."

The Assignee is reminded to pay the Assignor for the new "right of quiet enjoyment" and, as stated in section 3.3 above,  to "be aware that they [are} not purchasing the original title which once existed." Cleverly it includes, "Assignee has had the opportunity to take legal advice..."

Buyers receive docs from solicitors acknowledging that...something has been created without clarifying what. Another, drafted to "whom it may concern," suggests "holders wish to exercise their [non]rights in compliance with the Honours Act 1925." The Gazette notice feels official - but it isn't.
